Appeals

For over 20 years, Scott has briefed, argued, and won major victories for workers and other individuals in the Fifth Circuit and Texas appellate courts.

Over the last 20 years, Scott has written, argued, and won numerous appeals in the United States Court of Appeals for the Fifth Circuit and in other appellate courts.

For example, in 2001, Scott briefed, argued, and won in the Fifth Circuit a precedent-setting victory for religious liberty under the First Amendment to the United States Constituion: Tom Oxford v. Beaumont Independent School District, 240 F.3d 462 (5th Cir. 2001) (en banc).

In 2013, Scott briefed, argued, and won in the Fifth Circuit another precedent-setting victory for religious liberty: Kawaljeet Tagore v. United States, 735 F.3d 324 (5th Cir. 2013).

In 2019, Scott briefed and won in Texas’ Ninth Court of Appeals an important victory for employees subjected to on-the-job discrimination by their employers: Marci Hocevar v. Molecular Health, Inc., 593 S.W.3d 764 (Tex. App.—Ninth 2019)

In 2019, Scott also briefed, argued, and won in Texas’ Fourteenth Court of Appeals an important victory for employee whistleblowers: Cathryn Davis v. Apache Corporation, 573 S.W.3d 475 (Tex. App.—Houston [14th Dist.] 2019). Unfortunately, in June 2021 the Supreme Court of Texas reversed the Fourteenth Court of Appeals’ decision. Yet, the Supreme Court’s reversal has been strongly criticized by the Houston Chronicle and the San Antonio Express News, among others, because it occurred shortly after Apache contributed $250,000 to a political action committee (“PAC”) that supported several of the justices’ election campaigns and after Apache’s outside law firm’s PAC made sizeable contributions directly to those justices’ campaigns. Scott’s appellate experience includes having served as a judicial law clerk to the Honorable E. Grady Jolly on the United States Court of Appeals for the Fifth Circuit from 1989-1990.

Because of his extensive and unique appellate experience, other lawyers frequently consult and retain Scott to assist them with their appeals.
